What will happen at my hearing? PDF Print E-mail

At your hearing, you will be heard by a judge and you will also have your lawyer with you. There may also be a lawyer representing the government. Your family members may be present. It is not a large gathering.

The judge will ask you many of the same questions answered on your Personal Information Form (PIF) in order to hear you say them. It is easier to test the truth of your claim by hearing you speak. Simply answer honestly about your story. The judge will also know about the situation in your country as part of their preparation for the hearing.

Below are some questions they will most likely ask. It is important to be prepared to answer these with what truly happened to you.

  • Why should Canada not send you back?
  • (If you lived in the US) Why did you not apply for asylum in the US?
  • (If you did apply) Why did they not grant you asylum?
  • Why did you leave your country?
  • What evidence can you provide to corroborate your story?
  • (If the situation in your country has improved) Why can you not go back home now?
  • (If your family is still there) Why are your family members not in danger?

Your lawyer should help prepare you to answer these questions and to answer others. Normally, your lawyer cannot answer for you, but may clarify your answers if needed.
